Acceptable Use Policy

The Digital Millennium Copyright Act (DMCA) was passed by Congress in October of 1998. As described in the DMCA, Saint Elizabeth University is considered an Online Service Provider due to the fact the University is "an entity offering the transmission, routing, or providing of connections for digital online communications, between or among points specified by a user, of material of the user's choosing, without modification to the content of the material as sent or received."

Subsection 512 of the Copyright Act limits SEU's liability as an Online Service Provider assuming SEU's agent is registered with the Copyright Office and is made publicly available on the University's website.

Subject to the conditions of notification in Subsection 501 (c)(3) of the Copyright Act, SEU will notify the party of the alleged violation and require the content to be removed immediately. Violations will be handled in accordance with SEU's File Sharing Policy. Be aware that legal action by an official representative of the owner of the copyrighted material is an option that could be pursued.

A typical DMCA notification letter will include:

  • The offending party's IP address, directly identifying the computer used
  • The title of the file allegedly in violation
  • The timestamp of the alleged violation
